O Sindicato dos Metalúrgicos do ABC está preparando um Projeto de Lei (PL) para conferir mais segurança e maior legitimidade aos acordos coletivos classistas, permitindo que tenham força de lei e fiquem acima da própria Consolidação das Leis Trabalhistas (CLT).<br>
"É muito difícil ter um acordo 100% dentro da lei", diz o presidente da entidade, Sérgio Nobre. <br>
Tradicionalmente vendo propostas de mudanças na legislação trabalhista com desconfiança, desta vez os sindicalistas resolveram mudar de postura. A proposta deve ser apresentada ao governo em abril.<br>
"Até lá queremos publicar um livro com economistas, juristas e representantes do trabalho com suas opiniões sobre o tema", diz Nobre. Segundo ele, até o momento o projeto foi discutido com parlamentares, representantes de empresas e economistas.<br>

<strong>Exemplo negativo</strong><br>
O objetivo do projeto é evitar exemplos como o parecer de um fiscal da justiça do trabalho que, em 1998, por pouco não inviabilizou um acordo entre Volkswagen e o sindicato que permitiria evitar demissões.<br>
O documento foi questionado porque previa o parcelamento da participação nos lucros e resultados em 12 vezes, mais que os seis meses permitidos pela lei. O acordo se manteve após votação apertada no Tribunal Superior do Trabalho (TST) e serviu de alerta para a insegurança jurídica do tema.<br>
O projeto dá força de lei para os acordos estabelecidos entre sindicatos profissionais e empresas, desde que respeitados os direitos previstos no artigo 7º da Constituição, tais como férias, aposentadoria, 13º salário e o Fundo de Garantia por Tempo de Serviço (FGTS).<br>
O instrumento será de caráter facultativo, a ser utilizado em caso de comum acordo entre as partes — e exige uma organização sindical comprovadamente representativa.<br>
"O acordo seria positivo para ambos os lados, na medida em que acabaria com a insegurança jurídica que pode transformar o acordo num passivo para a empresa", diz Nobre.<br>
A certificação dos sindicatos fica a cargo do Ministério do Trabalho e demanda a existência de comitês sindicais de empresas com representação prevista no estatuto do sindicato. Os comitês devem ser reconhecidos pelas companhias que tenham interesse em adotar o instrumento.<br>
Além disso, o projeto prevê que as empresas participantes tenham sindicalização mínima de mais da metade dos trabalhadores e não possuam discussões judiciais ou extrajudiciais relativas ao impedimento do exercício de direitos sindicais. Após firmado, o acordo deve ser aprovado por 60% dos trabalhadores.<br>

<strong>Processo gradativo</strong><br>
Projetos anteriores já previam o fortalecimento das relações trabalhistas, como aquele que tentou a alteração do artigo 618 da CLT, apresentado no último ano do governo Fernando Henrique Cardoso.<br>
A diferença da proposta do sindicato é que o projeto prevê o uso facultativo, o que permitiria uma adaptação gradativa do instrumento, priorizando os locais onde as relações de trabalho estão mais avançadas.<br>
Para outros sindicalistas, o acordo pode ser utilizado inicialmente nas cidades que concentram as grandes indústrias. "Mas o impacto pode ser muito maior, porque o que é pouco no começo tende a evoluir rapidamente", diz José Lopez Feijó, diretor da Central Única dos trabalhadores (CUT).<br>
