vulnerable residents will have to get used to a new personal carer as part of a
controversial council shake-up, it has been confirmed.</DIV>
<DIV class=va-bodytext id=va-bodytext>The re-tendering of contracts for 800
severely disabled and elderly people in the city has left only 36 people with
their original care package, while almost 200 have taken the employment of
carers into their own hands under the "direct payments" sch

<DIV id=ds-mpu></DIV></DIV>eme.<BR><BR>The remainder face losing a carer they
may have known for years as the service is switched to a private
company.<BR><BR>It has led to strong criticism of the council by charities and
opposition politicians, who say they are compromising the care of people in
order to save cash.<BR><BR>Ian Hood, co-ordinator for the Edinburgh-based
Learning Disability Alliance (LDA), said: "People are being told their services
are to change, and some are even refusing to let new people through the door,
that's how strongly they feel about it.<BR><BR>"This decision to re-tender the
contracts was purely a financial one, and the council is even boasting now about
how much money has been saved. <BR><BR>"But the people affected receive very
intimate and specialised care, and they become so close to their carer that when
they lose them, they say it feels like a bereavement."<BR><BR>Meanwhile, local
authority chiefs have frozen applications for the direct payments process – the
Scottish Government-endorsed scheme which allows those needing care to choose
their own supplier. The Evening News reported earlier this month how there had
been a surge of applications as people tried to ensure they kept the same
carer.<BR><BR>The health spokeswoman for the Labour Party in Edinburgh, Cllr
Lesley Hinds, said: "<BR><BR>It's doing irreparable damage to the
service."<BR><BR>Cllr Phil Wheeler, the city's finance leader, said: "The
proposed arrangements will improve the way we deliver care and support services
for a number of people in Edinburgh.<BR><BR>"The organisations which tendered
for the work were assessed against rigorous quality and cost criteria. As well
as ensuring a consistent quality of service, the proposals would also allow the
council to extend the services provided to a greater number of service users in
the future."<BR><BR><STRONG>'THE UNCERTAINTY IS AFFECTING BOTH OF
US'</STRONG><BR><BR>ONE woman who contacted the Evening News is concerned about
the impact of changes on her grown-up daughter.<BR><BR>The woman, who did not
want to be identified, said the uncertainty was affecting them both. They
previously received a comprehensive care package from a local non-profit
organisation, but this will now change with the re-tendering
programme.<BR><BR>She said: "We'd considered direct payments but wanted to see
how the re-tendering went. Now we want to go with direct payments, but can't

<DIV class=comment>Again the vulnerable are victims here - The contracts are
untenable if to many service users transfer to direct payments. So the council
are stopping applications until after the implementation of the contracts, so
that when it goes wrong they can say it is the fault of the new
companies.<BR><BR>The services users will swap to direct payments though, as the
"winners" of this tendering process are mainly "for profit" companies with Care
Commission reports that are not comparable to the high standards provided
currently by the voluntary sector in Edinburgh - who have mainly been sidelined
by this process - as they know that to provide a quality service does cost
money. <BR><BR>The talk from Cllr Wheeler of "rigourous quality" is laughable -
it's like they took the Care Commission inspection reports and flipped the list
upside down - awarding the less good services the contracts.<BR><BR>Or maybe
they decided solely on price.<BR><BR>A quick google search for "domiciliary care
scotland" gives an idea of the "rigourous quality" standards the Council are
talking up...<BR><BR><BR></DIV>

to a care provider that has been investigated by Panorama and deemed by the Care
Commission to have unacceptable standards of care. Choices Community Care,
potentially one of the biggest winners of contracts from the Council, has just
taken over DCS. This is what the BBC says about DCS, following th Panorama
programme: <BR><BR>Britain's Homecare Scandal<BR><BR>Care of the elderly is a
lucrative industry after the doors were opened to private companies in the
1990s. Research from the London School of Economics, commissioned by Panorama,
found that 70% of home care is provided by the independent sector today and is
worth £1.5 billion. The figure was just 2% in 1992. English local authorities
spend around £22 an hour providing elderly care, but the independent sector
provides it for around half that.<BR><BR>Secret filming showing people in a car
park<BR>One company assigned carers their jobs in a car park every
morning<BR><BR>Panorama went to South Lanarkshire in Scotland where an online
auction decided the council's new care provider. Domiciliary Care won the
auction which saw bidders bidding down, not up. It's one of Scotland's largest
care providers looking after more than 1,500 people. While it won with a bid to
provide care for £9.95 an hour, South Lanarkshire says the decision to award the
contract was based only 40% on price with 60% based on quality of
care.<BR><BR>Is the Council sacrificing quality of care for the most vulnerable
to make savings? Why have they not stayed with local providers who have a proven
track record?</DIV>

planning is a disaster waiting to happen.<BR>The disabled person will then
become an employer and have responsibility for the cash, an impossible situation
if they have learning difficulties. If things get harder on the economic front
the council will be forced to reduce the level of payments thus also reducing
the number of hours care that will be available. This is a very bad

<DIV class=comment>The City of Edinburgh Council is lying when it says it has
awarded these contracts based on quality of service. Choices Community Care is a
private company with a poor track record who were only graded 3, or 'adequate'
by the Care Commission. Meanwhile some of the losers from this decision are
reputable voluntary sector organisations who have been providing high quality
services to disabled people in Edinburgh for decades and are rated by the Care
Commission as grade 5 or 'very good'.<BR><BR>The council has also put a stop on
people applying for Direct Payments which the Disabled People's Movement has
campaigned for over many years. Direct Payments give disabled people choice,
control and dignity over their own lives. Direct Payments might have enabled
disabled people in Edinburgh to choose their own care provider and if they had
wanted to stay with the organisation that has been providing their care for
years and the staff know them, then they could have.<BR><BR>Instead the council
has left hundreds of disabled people without a choice about who is coming into
their homes to provide their care, taken away funding from reputable voluntary
sector organisations, jeopardised the jobs of many dedicated support workers and
care staff. And all in the name of saving money. <BR><BR>What happened to
service users having choices or being consulted? Did the City of Edinburgh
Council carry out an impact assessment on disabled people? Did they consult any
of the disabled people affected? What criteria did they use in awarding the
contracts to private companies over the charity sector?<BR><BR>I think someone
should challenge this legally in the courts.</DIV>

<DIV class=comment>As a social care worker I am expected to sign up to the
Scottish Social Services Council's Code of Practice as are all staff working in
social service. <BR><BR>Pt 1.3 of the code requires Social Service workers to
support service users' rights to control their lives and make informed choices
about the service they receive. Pt 1.2 Respecting and, where appropriate,
promoting the individual views and wishes of both service users and carers.
<BR><BR>The Council's actions riding roughshod over this any Social Service
staff involved could be seen to be breaching the code and the local authority
breaching its responsibility not to do anything that would put its staff with
the code at risk (see employers section of the code 2.4)<BR><BR>Council
officials have failed to consult service users and carers often informing them
of what was going to happen rather than offering any real choice. What choice
there was i.e. to choose to have a Direct Payment has been curtailed and
distorted by the Council's decision to freeze Direct Payments till after the
tender has been completed. This denies individuals choice and control. </DIV>

<DIV class=comment>re 7: Direct Payments and Person centred Planning are two
very different things. Direct payments is a method by which an employer is geven
control of funds so they can either employ their own staff, contract with
agencies or contract with a local authority. <BR><BR>Person Centred Planning is
a process by which an individuals choices and needs are identified and a plan
geared towards them as an individual is designed and implemented.<BR><BR>Many
people with learning difficulties have made use of Direct Payments for years
with differing degrees of support to manage the package.<BR><BR>The cost of
managing a Direct Payment does not need to be higher or different to that of
services purchased directly by the local authority. Indeed it would be a breech
of Direct Payment guidelines to put DP recipients at a disadvantage this way.
The highest hourly rates are probably those when support is provided by local
authority services which I might add were not included in the tender.</DIV>
