AB 
540 allows qualified undocumented students to be exempt from paying 
significantly higher out-of-state tuition at public colleges and 
universities in California. By making college
 more affordable, AB 540 has had a significant impact on the lives 
of many undocumented students who have dreams of attending college.

Students are eligible for the AB 540 exemption if they meet ALL of 
the following
 requirements:

Attend a California high school for 3 or more years;Graduate from a California high school or receive the equivalent, 
such as a GED;Submit an affidavit (a written promise) to the California public 
college or university where they are attending or plan to attend. In 
this statement students declare that they meet all AB 540 requirements 
and if they are undocumented, that they have filed an application to 
adjust their immigration status or will do so as soon as they are 
eligible to do so. A

OVERVIEW
Academic Students
The F nonimmigrant category allows qualifying academic students to study in the U.S. in approved academic institutions. To obtain student status, a person must show that he or she –
􀂃 has been accepted by an approved academic school in the U.S,
􀂃 has the financial resources to complete the planned course of study without working in the
 U.S., and
􀂃 plans to return abroad when he or she completes the program.
Husbands, wives and unmarried children under 21 of F nonimmigrant students can be granted F2 dependent status to accompany the student.


The green card process can be complicated and basically they would have to return to their county of orgin and apply for a visa which would lead to a green card; or, directly apply for a green card, then once they have a green card apply for school.
