The asylum and immigration tribunal reversed an earlier decision and ruled Zimbabweans did not automatically face "a real risk of being subjected to persecution or serious ill-treatment" if returned to Robert Mugabe's regime. Last October the AIT threw the government's deportation policy into doubt after a failed asylum seeker, who can be identified only as AA, won his appeal against the home secretary. But that decision has been reconsidered after the court of appeal ruled in April that the tribunal had "erred in law" in making its initial decision." During the early phase of the study, in particular, reliance for initial placements on hotels or other emergency accommodation was not uncommon. However, the young people who 'agreed' to be dispered from Kent to Greater Manchester volunteered to do. The plan that is now being discussed is to disperse children across the UK on a NO CHOICE basis, even though there is no explicit legislative or regulatory mandate allowing this. This National Pilot research was also undertaken and finished before the 2003 'Hillingdon judgement' and LAC 13 circular, as detailed below. (save for 2006 amendments) Croydon director backs review of asylum provision for unaccompanied children "The Home Office wants the cost of supporting unaccompanied minors to be cut. But the Refugee Children's Consortium, a group of charities including The Children's Society and Barnardo's, is concerned that this is the main driver behind the plans. An initiative similar to the safe case transfer model, which involves the transfer of full responsibility for an unaccompanied asylum seeker from one council to another, is expected to feature in the new plans. 27 July 2006 http://www.communitycare.co.uk/Articles/2006/07/27/55119/Croydon+director+backs+review+of+asylum+provision+for+unaccompanied.html Notes: For a number of years local authorities had been acting unlawfully and only helping children seeking asylum alone with basic housing and finance and little else. Added to dispersing them across the UK via the commissioning of for profit private providers who have little or no history of supporting children. This was facilitated by the argument that children particularly aged 16 to 17 only needed discretionary help under Section 17 of the Children Act (1989). However, in 2003 2 court cases and an associated local authority circular specifically said: Local Authority Circular LAC (2002) 13 "...where a child has no parent or guardian in this country, perhaps because he has arrived alone seeking asylum, the presumption should be that he would fall within the scope of section 20 http://www.asylumsupport.info/childreninneed.htm and At the heart of the Council's case is its contention that these four claimants were not provided with accommodation under section 20 of the 1989 Act, (The Children Act 1989) they were merely provided with services under section 17 of the Act. http://www.asylumsupport.info/everychildmatters.htm Which meant that as with other children in the UK, children seeking asylum alone are entitled to support under the Children (Leaving Care) Act 2000: http://www.opsi.gov.uk/acts/acts2000/20000035.htm Their complaint is that the defendant owed and still owes duties to them under the Children (Leaving Care) Act 2000 ("the 2000 Act") and has failed to discharge those duties. http://www.asylumsupport.info/everychildmatters.htm Court case: B, R (on the application of) v London Borough of Merton [2003] EWHC 1689 (Admin) (14 July 2003) "However, on 13 February 2003 the Defendant determined that he was aged at least 18. But, if he is under 18, and is in need, he is owed a duty under Part III of the Children Act 1989 by the local authority in whose area he is, including a duty under section 20 of that Act, to provide him with accommodation. In these proceedings the Claimant seeks the judicial review of that determination. The Defendant must reconsider the age of the Claimant." http://www.asylumsupport.info/ageassessment.htm Some further background: Local Authority Support to Unaccompanied Asylum-Seeking Young People - report from Save the Children (PDF) (January 2006) Changes since the Hillingdon Judgement (2003) In 2003 there were a number of legal and policy developments that provided some clarity on the social services entitlements of unaccompanied children and young people. The two key ones (access details below) were the Hillingdon judgement and Local Authority Circular (2003) 13 (subsequently referred to as LAC 13 in this report). They made explicit the level of support that was expected of local authorities for unaccompanied children and young people. This support includes the following: - All unaccompanied children should, on arrival, be supported under Section 20 of the Children Act (1989) until an assessment has been completed. - Based on assessment of need, most unaccompanied children, including 16- and 17-year-olds, should be provided with Section 20 support. - The majority of unaccompanied young people will be entitled to leaving care services. ?Section 17 (which generally provides less care and support than Section 20) can be used to accommodate unaccompanied children in exceptional circumstances. This report looks at how 18 local authorities have tried to implement the Hillingdon judgement and LAC 13 and highlights the gaps in support to unaccompanied young people that continue to exist. "...where because of their immigration status the Children Act provides their only lawful means of support in this country. In such cases the child's being without a family or responsible adult in this country would appear to trigger a duty under section 20(1), http://www.asylumsupport.info/childreninneed.htm Court case: Hillingdon judgement The Queen on the application of Helen Berhe, Yorsmame Kidane, Wahdat Munir, Albertina Ncube (claimant) v The London Borough of Hillingdon (defendant) - Secretary of State for Education and Skills (interested party) "Their complaint is that the defendant owed and still owes duties to them under the Children (Leaving Care) Act 2000 ("the 2000 Act") http://www.opsi.gov.uk/acts/acts2000/20000035.htm and has failed to discharge those duties. At the heart of the Council's case is its contention that these four claimants were not provided with accommodation under section 20 of the 1989 Act, (The Children Act 1989) http://www.hmso.gov.uk/acts/acts1989/Ukpga_19890041_en_1.htm they were merely provided with services under section 17 of the Act. In my judgment, the defendant's argument is mere sophistry, based upon a distinction without a difference. In these circumstances, it does not do any violence to the statutory language, to the policy underlying Part III of the Act or to elementary common sense (our emphasis) to say that the claimants were indeed being "looked after" by the defendant. For these reasons, all four applications succeed... Date: Thu, 10 Aug 2006 21:38:38 -0700 Dear Friends, As the awful civilian death toll rises above 1000 in Lebanon and Israel, people around the world are seeking a place to voice their frustration and concern. Over the last 4 days, 200,000 people from 148 countries have signed the ceasefire petition. At this rate, we could soon be the largest global online petition in history. The pressure is working. The global outcry over this crisis has pushed the Ambassadors to the UN Security Council to work around the clock to achieve an immediate ceasefire. The latest word is that the Council may be close to a final vote today or tomorrow, but we've been this close before and negotiations have fallen apart. We need more pressure now to close the deal. Please forward this email on, spread the word to your friends, family and colleagues, post a link on your blog, bring up the campaign in discussions, and urgently encourage people around you to join this global wave of protest by signing up at the link below: http://www.ceasefirecampaign.org/mo/en.html The pressure is working. Solihull Demo - 25th Aug As usual, the Solihull picket is taking place on the last Friday of the month. It was suggested that the theme for this month be Deportation, especially with the escalating deportation of Zimbabweans and Iraqis and the revival of West Midlands Anti-Deportation Campaigns (http://www.indymedia.org.uk/en/regions/birmingham/2006/08/347947.html). Please make sure you bring the usual stuff: banners and placards, megaphone, pots and pans, chalk etc. Felipe is gonna do a new quick banner with the words "Stop racist deportations". 2. Internation Day of Action - 7th Oct October 7th will see the 3rd Day of Migration-Related Actions (the 1st and 2nd were on 31 Jan 2004 and 2 Apr 2005 respectively - http://www.indymedia.org.uk/en/2005/04/308307.html). It was agreed to add Birmingham NoBorders to the list of signatories supporting the call for action, which was agreed on at the European Social Forum in Athens in May 2006 (read the call here: http://www.noborder.org/item.php?id=372). It was suggested to do something (picket, demo, direct action, banner-drop..?) in town rather than in Solihull. Or maybe we can do both? Things to do include: - flyer (this could simply be a copy of the call for action?); - publicity through all available channels; - co-ordinate with other interested groups (ARC, NCADC etc.). 3. West Midlands Anti-Deportation Campaigns Last Sunday, a number of failed and successful asylum seekers, along with their supporters, met at the Cottage Social Centre and revived the West Midlands Anti-Deportation Campaigns (WMADC) (see http://www.indymedia.org.uk/en/regions/birmingham/2006/08/347947.html). 3 people/families have already decided to run public campaigns, and there are a few from NCADC and NoBorders helping them with that. It's an awful amount of work, so it would be great if other people with time and experience got involved too. 4. Voucher swapping This is now happening at The Cottage every Thursday at 7pm. More people willing to take vouchers are desperately needed. We need a leaflet to publicise this. The feature that Shiar did, but was never published for different reasons, will hopefully be up on Indymedia next week. -- Shiar From frank.corrigan at frankslist.info Mon Aug 21 08:09:10 2006 From: frank.corrigan at frankslist.info (frankslist.info) Date: Mon, 21 Aug 2006 10:09:10 +0200 Subject: [noborders-brum] All UK, Europe and World news digests, up to 20 Aug 06 Message-ID: <68eb3a8a4be41c5f3a4a3be1a299259b@hornblower.ymlpnet.net> All UK, Europe and World news digests, up to 20 Aug 06 To get these newsletters direct, just enter your email address at: http://www.frankslist.info the asylum, immigration and rights information gateway Got something to share? _______________________ If you have any events, news or information to share with us or 5000 plus subscribers please send details by: 1.Email: frank.corrigan at frankslist.info 2.Fax: 0870 285 6021 3.Post: EXILE 27 Old Gloucester Street London WC1N 3XX :: Index A) 'Much ado about, harsher, tortoise, race-hate, restriction' 20 Aug 06 - Key concerns include balancing the fight against illegal immigration with access to protection, responsibility sharing, transposition of EU asylum legislation, asylum decision-making, return procedures, integration, resettlement and human rights in EU-Russian relations. ECRE notably calls for more respect of the asylum institution in line with Tampere, a review of Dublin II, the suspension of discussions on the safe country list and a number of safeguards in the proposed draft Return Directive. Showing… LAND & FREEDOM @ The Cottage Social Centre, Friday 25th 7pm The 1936 Spanish uprising is in full flow whilst in Liverpool unemployed and disillusioned David decides to leave his fiancee and travel to Spain as a volunteer where he meets the beautiful Blanca... This outstanding film offers a fascinating insight into the Spanish Civil war through the eyes of a young British volunteer, memorably portrayed by Ian Hart. Following his death in present-day Britain, his grand-daughter sorts through an old suitcase containing the mementos of his time in war-torn Spain, providing the framework for the story. Brilliantly directed by Ken Loach, the film is a poignant evocation of that same mix of beauty and ugliness, love and tragedy that other writers on Spain have portrayed, and which all those who have, in different ways, been captivated by that country will instantly recognise. The use of loosely-scripted dialogue to add spontaneity and immediacy is particularly effective. Altogether an unforgettable experience. WHERE?The Cottage Social Centre, 147 Kyrwicks Lane, Sparkbrook http://www.streetmap.co.uk/streetmap.dll?G2M?X=408140&Y=284947&A=Y&Z=1 You can get there pretty easily from town if you get on the no. 50 bus and get off at Highgate Fire Station, where Moseley Road meets Highgate Road (A4540). The Iraqi asylum seekers have been given letters today informing them of the deportation orders. They have all however refused to sign acknowledgement of the letters We call for all humanitarian organisations and refugee rights organisations to support the Iraqi Kurdish asylum seekers from Iraq and the efforts to stop their deportation. We ask you to support the campaign Coalition to Stop Deportations to Iraq, (website www.csdiraq.com). IFIR and CSDIraq also oppose the underhand methods being used by the Home Office to pressure large numbers of Iraqi Kurds to return to Iraq / South Kurdistan via the so-called ?voluntary returns? scheme.
