This "evaluation" is somewhat aimed at introducing a UK wide
dispersal system for children looked after by local authorities
under Section 20 of the Children Act (1989) and having entitlement
to local authority support up to age 24 under the Children
(Leaving Care) Act 2000. However, the young people who 'agreed'
to be dispered from Kent to Greater Manchester volunteered to do.
The plan that is now being discussed is to disperse children
across the UK on a NO CHOICE basis, even though there is no
explicit legislative or regulatory mandate allowing this.
This National Pilot research was also undertaken and finished
before the 2003 'Hillingdon judgement' and LAC 13 circular, as
detailed below. (save for 2006 amendments)

Croydon director backs review of asylum provision for unaccompanied
children
"The Home Office wants the cost of supporting unaccompanied minors to be
cut. But the Refugee Children's Consortium, a group of charities
including The Children's Society and Barnardo's, is concerned that this
is the main driver behind the plans.
An initiative similar to the safe case transfer model, which involves
the transfer of full responsibility for an unaccompanied asylum seeker
from one council to another, is expected to feature in the new plans.

Notes: For a number of years local authorities had been acting
unlawfully and only helping children seeking asylum alone
with basic housing and finance and little else. Added to dispersing
them across the UK via the commissioning of for profit private
providers who have little or no history of supporting children.
This was facilitated by the argument that children particularly
aged 16 to 17 only needed discretionary help under Section 17
of the Children Act (1989). However, in 2003 2 court cases and
an associated local authority circular specifically said:

"...where a child has no parent or guardian in this country, perhaps
because he has arrived alone seeking asylum, the presumption should be
that he would fall within the scope of section 20

1989 Act, (The Children Act 1989) they were merely provided with
services under section 17 of the Act.

failed to discharge those duties.

1689 (Admin) (14 July 2003)

"However, on 13 February 2003 the Defendant determined that he was
aged at least 18.

But, if he is under 18, and is in need, he is owed a duty under Part III
of the Children Act 1989 by the local authority in whose area he is, including
a duty under section 20 of that Act, to provide him with accommodation.

In these proceedings the Claimant seeks the judicial review of that
determination.

In 2003 there were a number of legal and policy developments that
provided some clarity on the social services entitlements of
unaccompanied children and young people.

The two key ones (access details below) were the Hillingdon judgement
and Local Authority Circular (2003) 13 (subsequently referred to as LAC
13 in this report). They made explicit the level of support that was
expected of local authorities for unaccompanied children and young
people.

This support includes the following:

- All unaccompanied children should, on arrival, be supported under
Section 20 of the Children Act (1989) until an assessment has been
completed.

- Based on assessment of need, most unaccompanied children, including
16- and 17-year-olds, should be provided with Section 20 support.

- The majority of unaccompanied young people will be entitled to leaving
care services.

•Section 17 (which generally provides less care and support than Section
20) can be used to accommodate unaccompanied children in exceptional
circumstances.

This report looks at how 18 local authorities have tried to implement
the Hillingdon judgement and LAC 13 and highlights the gaps in support
to unaccompanied young people that continue to exist.

Guidance on accommodating Children in Need
Local Authority Circular LAC (2002) 13
"This Circular will remain in effect until further notice.
"...where because of their immigration status the Children Act provides
their only lawful means of support in this country. In such cases the
child's being without a family or responsible adult in this country
would appear to trigger a duty under section 20(1),

Court case: Hillingdon judgement
The Queen on the application of Helen Berhe, Yorsmame Kidane, Wahdat
Munir, Albertina Ncube (claimant) v The London Borough of Hillingdon
(defendant) - Secretary of State for Education and Skills (interested
party)

"Their complaint is that the defendant owed and still owes duties to
them under the Children (Leaving Care) Act 2000 ("the 2000 Act")

and has failed to discharge those duties.

At the heart of the Council's case is its contention that these four
claimants were not provided with accommodation under section 20 of the
1989 Act, (The Children Act 1989)

they were merely provided with services under section 17 of the Act.

In my judgment, the defendant's argument is mere sophistry, based upon a
distinction without a difference.

In these circumstances, it does not do any violence to the statutory
language, to the policy underlying Part III of the Act or to elementary
common sense (our emphasis) to say that the claimants were indeed being
"looked after" by the defendant.

For these reasons, all four applications succeed...

Treatment of Asylum Seekers Call for Evidence

The inquiry will consider any significant human rights concerns
relating to the conditions of life for asylum seekers and failed
asylum seekers in the UK, focusing in particular on those relating to:

(i)   access to accommodation and financial support;
(ii)  the provision of healthcare;
(iii) treatment of children;
(iv)  the use of detention and conditions of detention and
       methods of removal of failed asylum seekers
(v)   treatment by the media.

Memoranda of evidence addressing any or all of the above matters should
be submitted to the Committee by 29 September 2006.

Bail for Immigration Detainees (BID) presents evidence from a week of
Harmondsworth fast track appeals heard in March 2006, and discloses
fresh evidence about the scale of the injustice in the fast track

The MRN has marked out three priority areas for its work in the

coming months. These are:

Working out a grassroots response to the possibility of a regularisation
(amnesty) policy for people without residence permits.

Mapping the ways in which immigration-related policies are dealt with in
the various government departments, and by regional and local
government, and amongst key NGOs (the 'Opportunity Map').

A policy focus on primary health care services to migrants.
