It's because of trademark problems. They have to defend their trademark or 
they lose it, so letting evryone just party with the name  "Red Hat", without 
and specific legal license to do this, causes legal problems in trademark 
law.

Don't forget, trademark, patents and database rights are distinct from 
copyright in law -- and as yey the free software community hasn't found a way 
to address these.
