“Rape on Trial”

On Sunday 25 June, Panorama puts "Rape on Trial", an investigation
produced by Films of Record with Roger Graef, whose 1982 documentary A
Complaint of Rape -- featuring Thames Valley police interrogating a
woman -- caused shock waves.

Women Against Rape served as consultants for this programme.  We are
available for comment after broadcast to address the key questions:  Has
the response to rape improved since the 1980s?  What is women’s
experience now?  Why is rape still not a priority for investigation by
the police and prosecution by the Crown Prosecution Service?  Why have
government changes not improved the conviction rate for rape?  Does
Panorama’s expose go far enough?  How can women finally win justice?

For 30 years we have helped thousands of rape survivors seek justice.
We led the 15-year campaign which finally made rape in marriage a crime,
pressed for a ban on sexual history questioning in court,* and have
called for better sentences and compensation. We highlight the hidden of
rape of children, the discrimination faced by prostitute women, by those
who know their attacker or have a history of mental health problems, and
by victims of racist sexual assault.  We advocated for two women who
made legal history when they won the first private prosecution for rape
in 1995, which resulted in an 11-year prison sentence on the same
evidence the CPS had rejected.  We are well placed to assess what has
changed – and what has not.

We can put you in touch with rape survivors we are working with now who
can speak about their responses to the programme and their own
experience.  They include:    

- “Chloe”, who is featured in the Panorama programme, who was raped at
age 16 by her boyfriend.  The crime was not properly investigated or
prosecuted.   The police refused to let her come back the next day to
check her statement, pressing her to finish it in one gruelling session.
The police went over her head to disclose the crime to her parents
although she was 18 at the time, but never took a statement from her
parents about the effects of the rape.  The CPS refused to meet her to
explain why the case was discontinued.  Five years on, she still faces
intimidation and threats from the accused.

- Ms B, raped at 15 by a neighbour.  The police lost evidence, and
waited three months before arresting the man.  The judge told the jury
to disregard her age, although she was below the legal age of consent.
This all contributed to a not guilty verdict.

- Ms L, who woke up to find a man sexually assaulting her, the morning
after a party where she’d been drinking.  She was "put on trial" in
court, undefended by the prosecutor, and the judge stopped the case
before the jury had a chance to hear corroborating evidence.  The man
had a previous conviction for rape.

-  Ms N, who guessed her drink had been spiked after she'd been out for
a meal with a girlfriend.  She found herself next morning covered in
bruises but had no memory of what had happened.  Forensic tests found
semen.  But the police failed to gather further evidence, told her to
wash her clothes, and closed the case.  She made a formal complaint
about the investigation to the IPCC.

-  Ms M, whose boyfriend and his friend drugged and raped her.  The
boyfriend was never charged; only his accomplice was put on trial.
Despite a doctor testifying in court that no human being could have been
conscious while sustaining such severe injuries, the man was found not
guilty.

This week, a Home Office report confirmed that sexual history evidence
continues to be used in rape trials, despite the Youth Justice &
Criminal Evidence Act 2000 which the government claimed would exclude
such evidence.  WAR had warned that the Act as drafted would not work.

07: Scots give warmer welcome to asylum seekers than the English

Scottish public attitudes towards asylum seekers in Scotland are more
tolerant than those in England according to new research published today
(Moday) by the Institute for Public Policy Research (ippr). But younger
Scots and those living in Glasgow - where the majority of asylum seekers
in Scotland are housed - were the least tolerant.
